ஆப்ரஹாம் லிங்கன் வாதாடிய வழக்கு!

அமெரிக்க ஜனாதிபதி ஆப்ரஹாம் லிங்கன் சிறந்த மேதாவி. புத்திகூர்மையுள்ளவர். மனிதாபிமானி. எளிமையானவர். இன்னும் பல சிறப்புக்களைக் கொண்ட இவரது கூற்றுக்கள் பலராலும் இன்றும் மேற்கோளாகக் கூறப்படுகிறது. இவற்றில் இடம் கருதி பத்தை மட்டும் இங்கு பார்ப்போம்:

 

I am a slow walker, but I never walk back.

 

Whatever you are, Be a good one.

 

Give me six hours to chop down a tree and I will spend the first four sharpening the axe.

 

Do I not destroy my enemies when I make them my friends?

 

The ballot is stronger than the bullet.

அவரது சுருக்கமான சூத்திர மயமான இதர மேற்கோள்கள் அனைத்தும் கூட அருமை தான்!

அவர் ஆரம்ப காலத்தில் வாழ்க்கையை நடத்த மிகவும் கஷ்டப்பட்டார்; கடுமையாக உழைத்தார். அப்போது ஒரு கொலை வழக்கை நடத்த குற்றம் சாட்டப்பட்டு சிறையில் அடைக்கப்பட்ட கைதி ஒருவர் அண்டினார். அவரோ நிரபராதி. இதை அறிந்த லிங்கன் அவருக்காக நீதி மன்றத்தில் ஆஜரானார்.

வழக்கு விசாரணைக்கு வந்தது.

 

லிங்கன் பதட்டமின்றி கொலை செய்ததை நேரில் பார்த்ததாகச் சொன்ன சாட்சியை குறுக்கு விசாரணை செய்ய ஆரம்பித்தார்.

அந்த ஒருவர் தான் முக்கியமான சாட்சி. ஏனெனில் அவர் தான் கொலையை ‘நேரில் பார்த்தவர்’!

குறுக்கு விசாரணை ஆரம்பித்தது:

 

லிங்கன் : நீங்கள் கொலை செய்யப்பட்ட நபருடன் கொலை நடப்பதற்கு சற்று முன்பு இருந்திருக்கிறீர்கள். துப்பாக்கியால் சுடப்படுவதையும் நீங்கள் பார்த்திருக்கிறீர்கள்?

சாட்சி : ஆமாம்

லிங்கன் : இருவருக்கும் அருகில் இருந்திருக்கிறீர்கள்

சாட்சி : ஆமாம்

லிங்கன் : அது திறந்தவெளியில் நடந்ததா?

சாட்சி : இல்லை, மரங்களுக்கிடையில் நடந்தது

லிங்கன் : என்ன மரங்களுக்கிடையில்?

சாட்சி : பீச் மரங்களுக்கிடையில்

லிங்கன் : இலையுதிர்காலத்தில் பீச் மரங்களின் இலைகள் அடர்த்தியாக இருக்கும்.

சாட்சி : அப்படித்தான் இருக்கும்

லிங்கன் : நீங்கள் கைது செய்யப்பட்டு கொலைக்குற்றம் சாட்டப்பட்டிருக்கிறாரே, அவர் சுட்டதைப் பார்த்தீர்கள்?

சாட்சி : ஆமாம்

 

லிங்கன் : எவ்வளவு அருகில் இந்தக் கொலை நடந்தது?

சாட்சி : முக்கால் மைல் தூரத்தில்

லிங்கன் : எங்கே விளக்குகள் இருந்தன?

சாட்சி : பாதிரியாரின் மேடைக்குத் தள்ளி

லிங்கன் : அது முக்கால் மைல் தூரத்தில் அல்லவா இருக்கும்?

சாட்சி : நான் அப்படித்தானே சொன்னேன்!

 

லிங்கன் : குற்றம் சாட்டப்பட்டிருக்கிறாரே, அவர் நின்ற இடத்தில் வெளிச்சம் இருந்ததா?

சாட்சி : இல்லை. வெளிச்சம் எதற்கு வேண்டும்?

லிங்கன் : வெளிச்சம் தேவை இல்லையெனில் எப்படி சுடப்படுவதைப் பார்த்தீர்கள்?

சாட்சி : நிலா வெளிச்சத்தில்

 

லிங்கன் : ஆக, நீங்கள் இப்படி சுட்டதை இரவு பத்து மணிக்கு பீச் மரங்களுக்கிடையே விளக்கு இருந்த இடத்திலிருந்து முக்கால் மைல் தூரத்தில் பார்த்திருக்கிறீர்கள். பிஸ்டலைக் கொண்டு குறி பார்த்து சுட்டதைப் பார்த்தீர்கள். அதை நிலா வெளிச்சத்தில் பார்த்தீர்கள். சரி தானே?

 

சாட்சி : ஆமாம், அதைத் தான் அப்போதே சொன்னேனே!

இளம் வக்கீலான லிங்கன் மெதுவாக தனது பாக்கெட்டிலிருந்து  ஒரு பஞ்சாங்கத்தை எடுத்தார். அதை நீதிபதியிடம் காண்பித்தார்.

குற்றம் நடந்த தினம் ஒரு அமாவாசை தினம் என்பதைச் சுட்டிக் காட்டினார்.

 

குற்றம் சாட்டப்பட்டிருந்த நிரபராதி விடுதலையானார்.

லிங்கனின் புகழ் அன்றிலிருந்து ஊரெங்கும் பரவத் தொடங்கியது.

Lincoln : You were with the murdered man just before, and saw the shooting?

Witness : Yes

Lincoln : You stood near the two men?

Witness : Yes

Lincoln :

Lincoln : Was it in the open field?

Witness : No, in the timber

Lincoln : What kind of timber?

Witness : Beech Timber

Lincoln : The leaves of beech are rather thick in autumn?

Witness : Rather

Lincoln : You could see the prisoner shoot?

Witness : Yes

Lincoln : How near did this happen to the meeting place?

Witness : Three quarters of a mile away

Lincoln : Where were the lights?

Witness : Up by the minister’s stand

Lincoln : That was three- quarters of a mile away?

Witness : I have already said so

Lincoln : Was there a candle where the prisoner was standing?

Witness : No. What would he want a candle for?

Lincoln : Then how did you see the shooting?

Witness : By moonlight

Lincoln : You saw this shooting, at ten o’clock at night, in beech timber, three-quarters of a mile away from the lights? Saw the man point the pistol and fire? Saw it all by moon light?

Witness : Yes, I have already said so.

Then the young lawyer slowly drew from his pocket an almanac and showed that on the night of the crime the moon was not visible.
